1.  ACCEPTANCE OF THE GENERAL TERMS OF SALE 

These General Terms and Conditions of Sale contractually govern the commercial relationship between Ultimate Fishing and the retailer, customer of this website http://ultimate-fishing.co.uk/.

The customer declares that he/she is aware of the following provisions before placing an order for products. By choosing to purchase products from this website http://ultimate-fishing.co.uk/, the customer expressly accepts the terms set out below.

In the event of any contradiction between these general terms and conditions of sale and any other document appearing on the site or distributed physically, these general terms and conditions shall prevail for all purchases made on this website.

2. PRICE

The prices displayed on this website http://ultimate-fishing.co.uk/ are in Euros, before tax, and exclude shipping costs. Transactions are denominated in Euros.

The price indicated in the summary of your order is the final price. This price includes the total price of the order with details of each product and delivery costs.

Ultimate Fishing reserves the right to modify at any time the offer published on this website http://ultimate-fishing.co.uk/ as regards products and prices, in particular due to constraints linked to suppliers. However, products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

In the event of an obvious error in the price due to a typing error, Ultimate Fishing reserves the right to cancel the sale. The customer will then be offered an alternative arrangement.

Our sales are made subject to retention of title. Products remain the property of Ultimate Fishing until full payment has been received.

3. ORDERING

Customers can order online on this website http://ultimate-fishing.co.uk/.

By clicking the 'Confirm Order' button after completing the online order process, you agree to accept these terms and conditions in full and without reservation.

The data recorded by Ultimate Fishing constitutes proof of all transactions between Ultimate Fishing and its customers. The data recorded by the payment system constitute proof of financial transactions.

Ultimate Fishing confirms to the customer that their order has been taken into account by e-mail to the address indicated by the customer.

In the case of payment by credit card, the sale is only considered concluded once the payment has been accepted by the Paybox secure payment system and the order has been confirmed by Ultimate Fishing.

Ultimate Fishing reserves the right to refuse or cancel any new order from a customer with whom there is a dispute. Furthermore, in the event of a problem relating to the processing of an order, Ultimate Fishing will contact the customer directly at the address provided by the customer in order to inform the customer and propose a solution.


When placing an order, the customer provides the following information under his/her sole responsibility:

In the event of an error in the recipient's details, Ultimate Fishing cannot be held responsible for the impossibility of delivery, particularly if the details are incomplete.

4. PRODUCTS

The products offered comply with current French legislation. They are produced and marketed by recognised manufacturers under their own responsibility.

Ultimate Fishing is completely independent in its selection of products.

Photographs of products are not contractual, nor are their precise weights or packaging, which may be modified by suppliers as their ranges evolve.

Ultimate Fishing reserves the right at any time and without notice to add or remove products from its catalogue.

      a - Rods

Be sure to open the rod packages lengthways. Please do not pull the rods out of the package (the guides don't like this!).
Models: The guarantee applies to all Tenryu, Megabass and Ultimate Fishing Engineering and rods.
Duration of guarantee in regular fishing action :

    •    Tenryu, Ultimate Fishing Engineering and Megabass models: lifetime warranty

    •    Amago, SixthSense, BigFish1983: Easy Bass, Sunrise: 2 years warranty from product delivery date 

Coverage: the warranty covers full replacement of the damaged element and/or its components.
Warranty exclusions: deliberate or accidental breakage outside of fishing activities. Damage caused by fire, theft, loss or modification of the rod, second hand.
Flat-rate charges: in the event of the guarantee not being honoured, there are flat-rate charges for the replacement of a rod or one of its components, which vary depending on the model (please consult us). To benefit from the service package the return of the rod or the broken element is mandatory and will not be returned.

      b - Megabass Reels

    •    Megabass reels are guaranteed for 5 years under regular conditions of use from product delivery date. Their use is strictly reserved for freshwater and the guarantee only applies in this case. Any reel used in a saltwater environment will not be covered by the warranty.

    •    Avert reels are guaranteed for 2 years under regular conditions of use from product delivery date.

5. PRODUCTS AVAILABILITY

Our product offers are subject to availability.

6. DELIVERY AREA,TIMES AND PRICES

      a - Delivery area

Delivery is limited to the following areas:   

    •    United Kingdom

    •    Ireland

      b - Order preparation

Between the order and dispatch, the preparation of the parcel takes between 12 and 72 hours, depending on the day and time the order is received.
Orders are only dispatched or given to the customer once full payment has been received.

      c - Delivery times

For the United Kingdom and Irland, the delivery time is 5 to 8 working days*.
* information provided by the carriers

The indicative total time between order and delivery (order preparation + delivery time) is therefore 2 to 5 days. Please add also the difference corresponding to the delivery time announced by the carrier.

Ultimate Fishing undertakes to exercise due care in the preparation and dispatch of packages.

      d - Receipt by the customer

            i – Delivery method

All the shipments are DAP (Delivered at Place). Traditional courier companies have been chosen for delivery. Most parcels will be transported by La Poste or TNT as long as the packages remain on French soil.
Products will be delivered to the address indicated by the customer when placing the order.

            ii – Schedules

Packages are delivered between 8.30am and 6.30pm, Monday to Friday.

            iii – Information required for delivery

First time delivery saves time and money for everyone involved: Ultimate Fishing, the carrier and the customer.
In order to ensure a first time delivery in the best possible conditions, we would be grateful if you could provide us with any useful information in the 'Comments' section of the order form, especially regarding the delivery address and the receptionist's availability: days of absence, times when the receptionist will be unavailable, key code, name of the doorbell, etc.

            iv – Receipt of package

It is the customer's responsibility to check that the package is in good condition upon delivery. In the event of shortages or damage, the Customer must make reservations at the time of delivery with the carrier or, where applicable, with the post office or parcel relay representative. These reservations must be noted on the delivery note. It is therefore advisable not to leave until you have opened and checked the contents of the parcel.
Then contact us at infos@ultimate-fishing.net with your contact details, order number and the nature of the problem so that we can arrange a new delivery.

In the event of repeated absence of the customer at the time of delivery, or in the event of failure by the customer to collect parcels left at the post office or parcel centre, any costs incurred in returning the products to Ultimate Fishing and resending the order will be borne by the customer.
A possible delay in delivery in relation to the deadlines indicated in these conditions does not give the right to claim damages from Ultimate Fishing.

Ultimate Fishing is released from its obligation to deliver in the event of force majeure such as war, riot, fire, strike, accident, natural disaster or impossibility of delivery by a supplier.

      e - Delivery charges

The delivery charges payable by the customer may vary depending on the geographical area, the delivery time and times and the weight or value of the items ordered. Delivery charges do not vary for the same order, regardless of the number of items ordered. 
For deliveries to the United Kingdom or Irland: Delivery charge of €60 excluding VAT

For orders over 1000 euros excluding VAT, Ultimate Fishing offers free shipping and insurance. Please note: Parcels must be individually checked on delivery.

Shipping costs are subject to change, in particular as a result of changes in the rates of courier companies.

7. PAYMENT

The price of the products is payable in cash on the day the order is placed. This price is indicated on the order confirmation sent to the customer by Ultimate Fishing.

Payment can be made by : 

    •    Credit card: Visa, EuroCard, MasterCard, CB

The Paybox secure payment system is used by this website http://ultimate-fishing.co.uk/.
The personal information that customers are asked to communicate is perfectly protected and encrypted before transmission to the processing centre.
A customer's order will only be considered effective once the payment centre has given its approval. In case of refusal from paybox, the order will be automatically cancelled. Ultimate Fishing will notify the customer by e-mail.

8. RETURN POLICY

The customer has 7 clear days from delivery (Article L 121-16 of the Consumer Code) to return an item.
Ultimate Fishing undertakes to exchange the item or to grant a credit note, or to reimburse the customer without any reason, provided that the item is returned unused and intact in its original packaging. The customer must be issued a duplicate of the ‘Return Voucher’ by the carrier.
If Ultimate Fishing is not responsible for the reason for the return (delivery in accordance with the order), the return costs will be charged to the customer and therefore deducted from the credit or refund or charged for an exchange. If the responsibility of Ultimate Fishing is at issue (delivery different from the order), these costs will be borne by Ultimate Fishing.
Items returned incomplete, damaged or soiled by the customer are in no case taken back.

9. LIABILITY

The products offered comply with current French legislation.
The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, Ultimate Fishing cannot be held responsible in the event of an error in one of these photographs or texts.
Ultimate Fishing cannot be held responsible for the non-execution of the contract in case of stock shortage or unavailability of the product, in case of force majeure, disruption or total or partial strike of postal services and means of transport and / or communications, flood, fire, disaster.
Hypertext links may lead to sites other than this website http://ultimate-fishing.co.uk/. Ultimate Fishing declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.
In addition, the customer undertakes to respect the conditions and precautions for use of the products, in particular if they are stipulated on the instructions or packaging, or on the product sheets on this website http://ultimate-fishing.co.uk/.
Ultimate Fishing cannot be held responsible for damages of any nature that could result from improper use of items delivered to the customer.
Ultimate Fishing can not be held responsible for any changes made by manufacturers and / or suppliers in the composition of items sold on this website http://ultimate-fishing.co.uk/.
In any case, Ultimate Fishing's responsibility will be limited to the amount of the order.

10. APPLICABLE LAW AND DISPUTES

This contract is governed by French law. The language of this contract is French. In the event of a dispute over its interpretation and/or execution, the Tribunal de Commerce de Vannes will have sole jurisdiction.
The customer and Ultimate Fishing will always favour an amicable solution before taking any legal action.
By virtue of articles 313-1 and following of the French Penal Code, fraud is defined as ‘the act, either by the use of a false name or false capacity, or by the abuse of a true capacity, or by the use of fraudulent manoeuvres, of deceiving a natural or legal person and thus determining, to his detriment or to the detriment of a third party, to hand over funds, securities or any property whatsoever, to provide a service or to agree to an act creating an obligation or discharge’.
The offence of fraudulent use of a means of payment is punishable by 5 years' imprisonment and a fine of €400,000. Attempted fraud carries the same penalties. Our site's policy is to prosecute anyone guilty of such attempted fraud. We will not hesitate to press charges, particularly on the basis of information provided when ordering online (IP address, surname, first name or delivery details).

11. PERSONAL DATA PROTECTION

The personal information collected from the customer is essential for processing the order, routing the order and drawing up the corresponding invoice.
Failure to provide this information will result in the order being refused.
In order to comply with the French Data Protection Act, Ultimate Fishing has made a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL) concerning the processing of personal information relating to customers.
